Different stages of a criminal case
There are different stages of a criminal case. If represented early on, you may be able to prevent the actual issuance of a criminal complaint. This is important because if a criminal complaint does not issue, then the criminal charge will not appear on your CORI (criminal offender record information), and that helps to ensure your privacy. Once you are arraigned the case is automatically included on your criminal offender record information (CORI). At arraignment there may be a question of bail or you may be released on personal recognizance or with conditions of release. After your arraignment, the goal is to minimize your exposure through a strategic and vigorous defense that provides every option available and creates the best conditions for your acquittal.
Post Convictions / Appellate
Were you denied a fair trial? Do you have a guilty verdict or criminal conviction as a result? If so, you know that this will effect your freedom, and your future. If you did not receive a fair trial or your criminal defense attorney provided an inadequate defense then now is the time to act. This is your last opportunity to fight the case, whether the conviction was in state or federal court. The Law Office of Nicole M. Procida can appeal your case and fight for your conviction to be overturned or vacated. Attorney Procida has extensive appellate experience having briefed, filed, and argued in excess of 40 Appeals before the Massachusetts Appeals Court and the Supreme Judicial Court.
Someone who has suffered a criminal conviction has a right to appeal that conviction to a higher court with the assistance of a Massachusetts criminal appeals attorney. An appeal is a request filed on your behalf to the appeals court to review the proceedings of your trial. Among other things, the appeals court would determine whether you were denied a fair trial.
There are cases where the issues need to be presented by a petition for writ of habeas corpus or Motion for New Trial or Motion to Vacate your Plea. For example, in cases where criminal lawyers act incompetently, it could be ruled that clients have been denied their constitutional right to the effective assistance of counsel which requires a Motion for New Trial filed before the Trial Judge. Every case is different. The Law Office of Nicole M. Procida will determine which procedural track to follow once we know the specific facts of your case.
Whether we file an appeal, a Motion for New Trial, or both, the final objective is the same: We want to obtain your freedom. Nicole M. Procida is the criminal defense attorney that can do just that.
